This matter is currently the subject of pending litigation in the Hancock Circuit Court, Commonwealth of Kentucky (Case No. 23-CI-00045). A jury trial is presently scheduled for April 22, 2026. As such, the issues described on this website have not yet been finally determined by the court.
In 2004, Freddie Wayne Johnson sold his home and the land beneath it to his brother, Rondal Johnson. The property had already been professionally surveyed in 2003 and measured 8.574 acres. Rondal and his family lived on the property for approximately eleven years until it was foreclosed on in 2014. In 2015, my wife lawfully purchased the property through a HUD foreclosure sale. Since that time, we have continuously occupied the land and invested more than $150,000 restoring and improving the property.
More than two decades after the sale, Mr. Johnson now claims that he did not convey the entire 8.574-acre tract. That claim appears inconsistent with multiple public records, including recorded deeds, foreclosure filings, a 2003 licensed professional survey, an affidavit from the surveyor affirming the conveyance of the 8.574-acre tract, and more than two decades of Property Valuation Administrator (PVA) tax assessments reflecting the same acreage.
At the outset of the current litigation, the Hancock County Property Valuation Administrator, Karen Robertson, notified us that she intended to reduce the taxable acreage associated with our parcel from 8.574 acres to approximately 2.00 acres, based upon information provided by Mr. Johnson. This proposed administrative change closely parallels the plaintiff’s claim and differs from the acreage reflected in the long-standing recorded deeds and tax records.
We have formally challenged this reassessment by filing a Notice to Preserve Objection to Administrative Reassessment in Hancock Circuit Court, Case No. 23-CI-00045, where the matter remains pending.
This dispute extends beyond one family or one parcel of land. Questions regarding the reliability of recorded deeds, foreclosure history, professional survey evidence, and long-standing tax records are issues that affect the broader security of property ownership and public confidence in land records.
