• October 22, 2002
Freddie Wayne Johnson contacted the Hancock County Property Valuation Administrator (PVA).
The PVA farm data card notes state, verbatim:
“Fred sold 6 acres and house to brother 2002.
Called 10-22-02 to get separate 6 acres and house on separate tax bill.
Deed acreage incorrect. Had the 2 acre parcel surveyed, turned out to be 6 acres.”
• June 23, 2003
Progressive Land Title contracted a licensed surveyor to survey the tract, then believed to be “6 acres” for Freddie Wayne Johnson.
Progressive Land Title provided the surveyor with the relevant Parcel Map.
Progressive Land Title provided the surveyor with the relevant Deed. (Deed Book 100 Page 241)
Progressive Land Title provided the surveyor with the relevant Work Order.
• June 30, 2003
The property was professionally surveyed and determined to contain 8.574 acres, not 6 acres.
• August 18, 2003
Freddie Wayne Johnson sold the adjoining 35-acre tract to his parents for $30,000.00 (approximately $857.14 per acre).
• The 2003 survey explicitly separates the 35-acre tract from the 8.574-acre tract.
This transaction was recorded in Deed Book 129, Page 787.
• May 14, 2004
Freddie Wayne Johnson sold the entire 8.574-acre tract to his brother, Rondal Johnson, for $66,972.67 (approximately $7,811.13 per acre).
• The deed was recorded with the Hancock County Clerk in Deed Book 131, Page 418.
• Hancock County PVA records reflect 8.574 acres for this parcel from this date forward.
• Foreclosure proceedings were filed in Hancock Circuit Court, Case No. 10-CI-00135, against Rondal Johnson.
• September 5, 2014
The Hancock Circuit Court entered a Final Judgment and Order of Sale in Case No. 10-CI-00135.
• Mr. and Mrs. Pace located the property listing, which clearly reflected 8.574 acres.
• Mrs. Pace contacted Jim Estes, Greater Owensboro Realty Company, to schedule a showing.
• After walking the property, the Paces provided a down payment and proceeded to closing.
• A HUD court-ordered sale was completed, conveying the full 8.574-acre tract.
• The deed was recorded with the Hancock County Clerk.
• From 2015 forward, property taxes were paid on the full 8.574 acres.
• March 13, 2023
Attorney Tommy Littlepage sent a letter to Mrs. Pace, stating she was “in effect trespassing” and threatening removal through Hancock District Court.
• March 18, 2023
Hancock County PVA Karen Robertson sent the Paces a letter stating:
“It has been brought to my attention that there may be some titling issues that affect your property… Please contact my office as soon as possible so we can discuss.”
• Upon contacting the PVA, the Paces were informed that Freddie Johnson claimed he “only sold 2 acres,” and that it “appears Freddie Wayne Johnson still owns the 6 acres.”
• May 15, 2023
The PVA reduced the Paces’ assessed acreage from 8.574 acres to 2.00 acres, without notice, hearing, or recorded legal instrument.
• June 21, 2023
Freddie Wayne Johnson filed suit seeking to divest the Paces of their property.
